§ Conditions of Contract

Conclusion of contract: By starting the ordering process by clicking the corresponding order button, the buyer accepts the following agreements in all points.
Rights of use: The buyer is entitled to use the purchased titles on a single system, to modify the titles at will, and to make a backup copy for data security purposes. Any other type of reproduction and distribution as well as the resale of the created copies, as well as the modified titles, is prohibited.
Multiple use: Original and copy may under no circumstances be operated simultaneously on multiple systems. The title may only be made available to third parties insofar as this is strictly necessary for one's own use.
Accompanying material: The written accompanying material as well as the supplied digital additional files may not be reproduced in whole or in part in any form, except for the purpose of personal archiving. Supplied text files may be printed or reproduced a maximum of five times for own use.
Exclusion of commercial distribution: The music title created through processing on your own system may not be resold in any form as a data carrier, sound carrier or as printed sheet music. The creation of a demo audio recording for presentation and the associated distribution to potential customers of the buyer is permitted. However, this passing on of the recording must not serve a commercial end in itself, but only for demonstration purposes. Of course, the corresponding copyright (e.g. GEMA) fees for this distribution must be paid by the buyer, as it involves commercial use.
Disclaimer: The authors of the music titles commit themselves to proceeding conscientiously and professionally in their creation, but assume no guarantee for their absolute correctness.
Right of withdrawal & Exchange: Our products are digital content that is not supplied on a physical data carrier. Upon concluding the purchase, the customer expressly agrees that the execution of the contract (start of download or provision in the customer account) will begin before the expiry of the withdrawal period. The right of withdrawal expires with the start of the execution of the contract. An exchange is excluded, unless the delivered data is technically defective. In this case, midiart.media will provide a replacement.
Resale: In the event of a sale of a title, the seller must irrevocably delete any copies and backup copies so that no copy of the respective title remains with him.
Jurisdiction: We will report a violation of our terms and conditions without further notice. The place of jurisdiction for all disputes arising from this contract is, as far as legally permissible, 45475 Mülheim an der Ruhr, Germany.
Terms of payment: All deliveries on account are payable within 14 days strictly net. The payment date is calculated from the time of provision or partial delivery. Any bank charges shall be borne by the client.
Default of payment: In the event of default in payment, the resulting costs will be charged to the client. We reserve the right to hand over the claim to a debt collection agency after the third unsuccessful reminder.
Delivery dates: Special delivery dates are only valid if they have been confirmed in writing by the contractor.
Default of performance: If the contractor defaults on its performance, a reasonable grace period must first be granted. After the fruitless expiry of the grace period, the client can withdraw from the contract. Compensation for damage caused by delay is limited to the amount of the order value.
Retention of title: The delivered goods or the rights of use remain the property of midiart, Oliver Böhnke, until full payment has been made.
Severability clause: The possible invalidity of one or more provisions shall not affect the validity of the remaining provisions. The invalid provision is to be replaced by a legally permissible regulation that comes closest to the economic purpose.
